The Forum of Commissioners of Power and Energy has voiced strong concerns over the proposed 2025 Electricity Act (Amendment) Bill, warning that it could spark constitutional disputes between the Federal Government and states, and derail recent reforms in the power sector.
In a joint statement by Eka Williams (Cross River) and Omale Omale (Benue), the forum said the bill would worsen the financial strain on both governments and consumers already grappling with high electricity tariffs and band classifications.
They argued that the proposed changes risk reversing gains made under the 2023 Electricity Act by imposing new financial obligations on electricity users and market operators—especially through mandatory contributions to the Power Consumer Assistance Fund (PCAF).
The forum further warned that the bill could create jurisdictional conflicts between federal and state regulators, violating the principle of cooperative federalism and triggering potential legal battles.
