The Court of Appeal in Abuja has dismissed Ondo State Governor Lucky Aiyedatiwa’s appeal challenging a Federal High Court ruling on his eligibility to contest the next governorship election.
A three-member panel unanimously held that the trial court acted correctly in allowing Akindele Egbuwalo to amend his originating summons. Justice Uchechukwu Onyemenam noted that Aiyedatiwa failed to prove any injustice or denial of fair hearing.
The appellate court:
- Dismissed Aiyedatiwa’s appeal for lacking merit
- Awarded ₦2 million in costs against him
- Rejected his application to set aside a January 27, 2026 order that stayed proceedings before the Federal High Court, awarding an additional ₦1 million in costs
The court emphasized that challenging its valid order would amount to “sitting on appeal over its own decision,” and advised Aiyedatiwa to seek recourse at the Supreme Court.
