Justice Emeka Nwite of the Federal High Court, Abuja, has scheduled September 29 for hearing a motion filed by the Osun State Government, challenging the court’s jurisdiction to entertain a suit over withheld local government funds.
At the resumed session, the state, through its counsel Musibau Adetunbi, SAN, argued that the case, initially assigned during the court’s vacation, should be returned to Osogbo for proper adjudication, as the vacation ended on September 16.
The motion also questioned the validity of a letter from the Chief Judge’s office allegedly authorizing Justice Nwite to continue hearing the case in Abuja.
